Terms & Conditions – Worn by Water
1. General and Scope
These Terms and Conditions govern all purchases and transactions made on wornbywater.com and constitute the full and binding agreement between the buyer and Worn by Water. By placing an order on wornbywater.com, you confirm and accept without reservation all terms and conditions set forth in this document in their entirety.
Worn by Water reserves the right at any time and without prior notice to update, modify or revise these Terms and Conditions. The version of the Terms and Conditions in effect at any given time is available on wornbywater.com and is binding for all orders placed after the publication of the updated version.

These Terms and Conditions are governed by and shall be interpreted in accordance with the laws of the State of Delaware, USA, without regard to its conflict of law provisions.
2. Orders, Order Confirmation and Agreement
2.1 Placing an Order
An order is considered placed when you have completed the checkout process on wornbywater.com and received an order confirmation to the email address you provided at the time of purchase. It is your responsibility to ensure that the email address provided is correct and functional. Worn by Water is not responsible for failure to receive an order confirmation due to an incorrect email address or spam filtering.
2.2 Formation of Agreement
The agreement between you and Worn by Water is binding from the moment you receive the order confirmation. The order confirmation constitutes confirmation that your order has been registered and is being processed — not a guarantee of delivery should extraordinary circumstances arise.
2.3 Right to Cancel Orders
Worn by Water reserves the right without liability to cancel an order in the following situations, this list not being exhaustive: your payment information is incorrect, cannot be verified, or is deemed suspicious; the order is assessed to have been placed with the intent to commit fraud or abuse; an unintended technical error on the website affects price or product information; you are under 18 years of age; or the order cannot be fulfilled due to circumstances beyond Worn by Water's control.
3. Age Requirement and Legal Capacity
To make purchases on wornbywater.com you must be at least 18 years of age and have full legal capacity to enter into binding agreements. By placing an order you confirm that you meet these requirements. Worn by Water reserves the right to cancel orders placed by persons under the age of 18 without further notice.
4. Prices, Payment and Tax
4.1 Prices
All prices on wornbywater.com are listed in US Dollars (USD). Applicable sales tax may be added at checkout depending on your state of residence in accordance with applicable US tax law. Worn by Water reserves the right to change prices without prior notice. The price applicable to your order is the price listed at the time of your purchase as stated in your order confirmation.
4.2 Payment Methods
We accept the following payment methods: Credit card (Visa and Mastercard), PayPal, Apple Pay and Shop Pay. Payment is authorized and charged when the order is placed. Worn by Water uses encrypted and secure payment solutions and does not store your payment information.
4.3 Payment Security
All payment communication takes place via encrypted connections. Worn by Water is not responsible for unauthorized access to payment information resulting from circumstances beyond Worn by Water's reasonable control.
5. Delivery, Shipping and Logistics
5.1 Delivery Area
Worn by Water delivers to all addresses within the contiguous United States. Delivery to Alaska, Hawaii and US territories as well as international destinations is not currently offered.
5.2 Delivery Time and Processing
Each piece is personally processed for you when you order. Delivery time is 10–14 days from your order — including processing time. Delivery times are estimates and may in special cases vary due to circumstances beyond Worn by Water's control, including delays with shipping partners, extraordinary demand or force majeure situations as described in section 12.
5.3 Shipping and Tracking
You will receive a tracking number so you can follow your package at all times. Tracking information is updated continuously by the shipping partner and Worn by Water is not responsible for delays in the updating of tracking data.
5.4 International Logistics Partners
In order to offer free shipping on all orders, Worn by Water works with international logistics partners that have the most efficient and cost-optimized shipping routes to the United States. Packages may therefore be dispatched from an international shipping hub and tracking may show sender countries that differ from the United States. This is standard practice in modern e-commerce and does not affect the product's quality, your right of return or your other rights as a consumer. International shipping hubs are used solely to keep shipping costs low for the benefit of the customer.
5.5 Uncollected Packages
If the package is not collected within the carrier's specified storage period it will be returned to Worn by Water. In this case Worn by Water will offer to resend the package upon payment of a new shipping fee or alternatively issue a gift card to the same value. Worn by Water is not responsible for costs or inconvenience arising from failure to collect a package.
6. Right of Return and Order Cancellation
6.1 Right of Return
As a consumer you have 30 days from the date you physically received the item to initiate a return. To exercise your right of return you must send a clear and unambiguous notification to susan@wornbywater.com before the expiry of the 30-day period. It is your responsibility to document that the notification was sent before the deadline.
6.2 Order Cancellation
Immediately after your purchase the processing of your order begins and cannot be stopped. If you wish to cancel your purchase please await delivery and then contact us to initiate the return process in accordance with section 7.
6.3 Exceptions to the Right of Return
The right of return does not apply to items that have been manufactured to the consumer's specifications or have taken on a clearly personal character. As each piece at Worn by Water is personally processed and prepared for the individual customer the right of return may in certain cases be limited. Please contact us at susan@wornbywater.com for a specific assessment of your situation.
7. Returns and Return Procedure
7.1 Return Policy
You may return the item within 30 days of receipt provided that the item is returned in the same condition and with the same packaging as when received. Items showing signs of use, damage or missing original packaging cannot be returned or refunded.
7.2 Return Procedure
To initiate a return please contact Worn by Water at susan@wornbywater.com with your order number and the reason for the return. You will then receive the return address by email. Do not send the package to the sender address shown on the package — this address is not Worn by Water's return address and packages sent there cannot be processed or refunded.
7.3 Return Costs
The cost of return shipping is the customer's responsibility and will not be deducted from the refund amount. Worn by Water recommends that you use a trackable shipping method and retain your tracking receipt as Worn by Water is not responsible for packages lost during return shipping.
8. Refunds and Refund Procedure
8.1 Processing Time
If your return is approved Worn by Water will refund all payments within 14 days of receipt and approval of the returned item. The refund will be made via the same payment method you used at the time of purchase unless otherwise agreed in writing.
8.2 Full Return Process
The full return process from dispatch to refund to your account typically takes 3–5 weeks depending on the shipping partner's delivery time and processing time. No return fee is charged by Worn by Water.
8.3 Partial Refunds
Worn by Water reserves the right to make partial refunds in cases where the item is returned in damaged condition or without original packaging.
9. Warranty and Defect Claims
9.1 Warranty Period
Your purchase is covered by a 12-month limited warranty in accordance with applicable US consumer protection law. The warranty covers defects and faults that were present at the time of delivery and that are not the result of normal wear, misuse or damage occurring after delivery.
9.2 Warranty Claim Procedure
If you discover a defect or fault with your piece please contact Worn by Water at susan@wornbywater.com with a photograph of the defect and your order number within a reasonable time after discovering the defect. Worn by Water will then assess the claim and find the best possible solution for you as quickly as possible.
9.3 Limitations
The warranty does not cover damage resulting from misuse, lack of maintenance, normal wear and tear or damage occurring after delivery.
10. Gift Cards and Credit Arrangements
10.1 Gift Cards as Alternative
In certain cases Worn by Water may as an alternative to return and refund offer a gift card for full or partial compensation. A gift card is issued to the email address associated with the order and is valid for 12 months from the date of issue.
10.2 Gift Card Limitations
A gift card cannot be refunded in cash and cannot be exchanged for money under any circumstances. A gift card that is not used before the expiry date lapses without compensation. Worn by Water is not responsible for loss of gift cards resulting from an incorrect email address or other circumstances beyond Worn by Water's control.
11. Disputes and Complaints
11.1 Direct Contact
If you wish to make a complaint about a purchase or experience with Worn by Water we encourage you to contact us directly at susan@wornbywater.com — we will always find a solution together.
11.2 External Complaint Options
If we cannot reach an agreement you may contact the Better Business Bureau (BBB) at www.bbb.org or the Federal Trade Commission (FTC) at www.ftc.gov. For disputes that cannot be resolved informally the parties agree to submit to binding arbitration in the State of Delaware in accordance with the rules of the American Arbitration Association (AAA). Worn by Water's email address in connection with complaints is susan@wornbywater.com.
12. Force Majeure
Worn by Water is not responsible for delays, non-delivery or failure to comply with these Terms and Conditions if this is caused by events beyond Worn by Water's reasonable control including but not limited to natural disasters, flooding, fire, strikes, lockouts, war, acts of terrorism, pandemics, government intervention, transportation disruptions or failure of third-party suppliers. In such cases Worn by Water will endeavor to inform you as quickly as possible and find an alternative solution.
13. Reservation for Price and Typographical Errors
Worn by Water makes every effort to ensure that all prices, product descriptions and other information on wornbywater.com are correct and up to date. Notwithstanding this Worn by Water reserves the right for unintentional errors in prices, descriptions or other information which will be corrected as quickly as possible after discovery. Worn by Water reserves the right without liability to cancel orders placed on the basis of obvious errors in pricing or product information.
14. Image Representation and Product Description
14.1 Colors and Screen Settings
Worn by Water makes every effort to reproduce the colors and appearance of products as accurately as possible on wornbywater.com. However Worn by Water cannot guarantee that colors are entirely accurately reproduced as this depends on the individual user's screen, screen settings, brightness and other technical factors.
14.2 Indicative Product Images
Product images on wornbywater.com are for guidance only. The piece you receive will have the same design and the same type of stone as shown in the image — but will never be identical to it. Products may vary in color, tone, texture and shape as each piece has its own character. Variations in the product's appearance compared to the product image do not constitute a defect and do not entitle the customer to return or refund unless the variation is significant and results from an error on Worn by Water's part.
14.3 Natural Stones and Inspiration from the Maine Coast
Worn by Water's pieces are designed with inspiration from the Maine coast and the natural stones found along the shoreline. Each piece has its own character — no two are alike. The stones included in the piece you receive are of the same type and character as the stones that inspire the collection — but are not the same stones.
15. Intellectual Property Rights
All content on wornbywater.com — including but not limited to text, images, logos, design, graphics and product descriptions — is owned by Worn by Water LLC and is protected by US and international copyright law. The content may not be copied, reproduced, distributed, modified or used in any form without prior written consent from Worn by Water. Violation of these provisions may result in liability for damages.
16. Limitation of Liability
16.1 Indirect Loss
Worn by Water is not liable for indirect loss, consequential damages, loss of business, lost profits or other forms of indirect loss arising from purchases on wornbywater.com or circumstances related thereto regardless of whether Worn by Water has been made aware of the possibility of such losses.
16.2 Liability Cap
Worn by Water's total liability to a buyer is under all circumstances limited to the value of the relevant order as stated in the order confirmation.
17. Governing Law and Jurisdiction
These Terms and Conditions are governed by the laws of the State of Delaware, USA. Any dispute arising out of or in connection with these Terms and Conditions or purchases made on wornbywater.com shall be resolved through binding arbitration in Delaware in accordance with the rules of the American Arbitration Association, unless otherwise required by applicable mandatory consumer protection law.
